Terms of Service

1. Who we are

"BJG Hosting" is a sole proprietorship operating in California, providing web hosting, web application development, and AI automation services. These terms govern your use of those services and this website.

2. Accounts

You are responsible for keeping your credentials secure and for activity under your account. Tell us promptly if you believe an account has been compromised. Accounts are created when a service agreement begins; we may suspend an account for non-payment or for breach of these terms.

3. Acceptable use

You may not use our services to host or transmit unlawful material, malware, phishing pages, or unsolicited bulk email, to infringe intellectual property rights, or to attack or disrupt any network or system. We may suspend a service immediately where continued operation would harm others.

4. Fees and billing

Subscriptions are billed in advance through Stripe at the interval shown on your plan. Fees are non-refundable except where required by law or where we fail to deliver a service you paid for. Prices may change with 30 days' notice; changes never apply to a period you have already paid for.

5. Your content

You retain ownership of everything you upload or ask us to host. You grant us only the limited licence needed to store, serve, and back up that content in order to run the service. You are responsible for having the right to use the content you supply.

6. Availability and backups

We aim for high availability and take nightly backups with offsite copies, but we do not guarantee uninterrupted service. Planned maintenance is announced in advance where practical. You should keep your own copies of anything you cannot afford to lose.

7. Termination

You may cancel at any time; service continues to the end of the paid period. We may terminate for material breach, or for any reason with 30 days' notice and a pro-rata refund. On termination we will make a copy of your data available for 30 days, then delete it.

8. Liability

Our services are provided "as is". To the extent permitted by law, our total liability for any claim is limited to the fees you paid in the three months before the claim arose. We are not liable for indirect or consequential loss, including lost profits or lost data, except where such exclusion is not permitted by law.

9. Changes to these terms

We may update these terms and will post the revised version here with a new date. Material changes will be emailed to active clients at least 30 days before they take effect.

10. Governing law

These terms are governed by the laws of the State of California, and the courts of Alameda County have exclusive jurisdiction over any dispute.
